A Chaska teen charged with second- and third-degree murder earlier this month has been released on a home monitoring system.
Carver County Attorney James Keeler confirmed that 16-year-old Brody (Bermel) Roehlke was released to his Chaska home on Sept. 8.
Roehlke was initially charged with first- and second-degree assault on Aug. 8 after an alleged altercation with his mother’s fiancé Kirk Anderson on Aug. 6. The altercation resulted in Anderson being transported to Hennepin County Medical Center (HCMC) with head injuries. Anderson died at HCMC on Aug. 9.
Keeler amended the charges against Roehlke to second- and third-degree murder on Sept. 2. Roehlke’s attorneys requested his release during a court appearance to address his amended charges. Keeler said his team objected to the request.
“We believe his continued detention is warranted based on the severity of the crime,” said Keeler. “We feel he is a risk to himself and to the public as well as being a risk to flee the area.”
Judge Kevin Eide agreed to Roehlke’s release with the condition that he be tracked by active GPS.
“He’s essentially on house arrest,” said Keeler.
Roehlke’s next significant court appearance will be on Oct. 1 when the motion to try him as an adult is heard. Keeler is pursing adult certification due to his age and the severity of the alleged crime, as dictated by state laws.
Following the court’s decision on whether or not he will be tried as an adult, he will be asked to enter his plea in the case.

Back to page topI was a friend of Kirk and don't know why Brody is out on house arrest. Was I upset? Of course I was, but what can I do about it. All I can do is be supportive of the friends and family of Kirk.
The legal system works in ways not all of us understand. The one thing I did was looked up second and third degree murder in Minnesota and it's defenses.
I thought I would try to educate myself a little on the charges and what could possibly happen.
I now understand what and why Brody is being charged for what he is. I also understand how his defense may work.
A lot of people are putting faith in the self defense idea. If you read about it, it says the jury has to decide if his(Brody's) defense was reasonable and he used only the force necessary to combat the aggressor. It also states the question of who his(Brody's) aggressor was. It also states that the defendant (Brody) has to agree that the act resulting in death occurred.
I have stated this because after all this happened everyone was throwing out comments of either Brody was defending himself or his mother.
There is also defense of others. This asks the same questions but also states that the defendant(Brody) must agree the act of death occurred, and must claim it was justified by the aggressors threatening actions towards a third person. Let me state that anyone is always presumed innocent until proven guilty.
Here's the deal people. I hear things about what happened, but I don't know a whole lot for sure. I read what all the others seem to know for sure and they seem to have the case closed. I don't care if your grandma, girlfriend, sister or brother from another mother was there, we will all find out the truth in the end, I hope. If the whole truth doesn't come out and things don't add up that means someone is hiding something. I, personally can deal with whatever happened and the outcome of all this. Here's where I struggle. If all of you who claim you know something actually go to court and go under oath to tell the truth and nothing but, this will be fair and just. If you want to save Brody and he means that much to you, you all better stand up for him and not just make asinine comments on this site. For those who know it all, and for all your friends that were there, just remember you have to be credible too. The prosecution will have to prove Brody is guilty of course, and if they can't do that, he will go free. Brody doesn't have to say or do anything in his defense.
By the way, I believe Sean Humphrey's dad posted a comment awhile back that he had forgiven Kirk for his role in Sean's death. So to you who are commenting on that, follow him and take some class and forgiveness from his father. I'm sure it wasn't easy for him, but it can't be easy seeing all of you bringing it up over and over again.
Here are a couple of things I have wondered about, and maybe you could answer them for me. Why was there a 4 foot pipe just laying around the yard? What was Brody doing outside when Kirk and Sheree got home? Why did Sheree ask Kirk to marry her if he was such a bad person and abuser. How do you claim self-defense if you intentionally hit someone while they were unconscious on the ground? Why was Brody so angry that night and out to get Kirk and saying he was driving under the influence? How can a 16 year old blame Kirk for his mother getting herself drunk? Why wasn't Sheree driving, she has a license, right? What was Kirk doing at a bar in the first place? Was he even suppose to be at one, and shouldn't Sheree know these things? Why did Sheree claim Kirk hit his head. I heard they were going to Vegas the next day. They weren't going there to get married, were they?
Do you get my point! I have a lot of questions and all of you seem to have the answers. I could go on and on and on. So until Brody goes to trial I won't know anything unless some of you have the answers.
Also, I can have empathy for the abused woman with child who can't get out of the relationship. What I don't have it for is someone who may blow some boxing matches out of proportion to protect her son, and degrade people who really are in a terrible situation like that. I just hope there are police reports of the alleged abuse to prove it.
I have so many questions, no answers, and just wish this would all move as quickly as possible for all of us.
Kirk was still someone's brother, son, grandson, nephew, cousin, boyfriend, DADDY and friend, so please just try to remember that. The same goes for Brody and Sheree. I try to respect that, and at times it's hard, but I do my best. I don't know Brody or Sheree, but Kirk cared for them and I have to respect that. We can all be angry at each other and say accusing things but where does that get any of us? It just makes us more angry and sad and puts us all in positions to say things we might not say otherwise.
All the comments and questions I have made are to the best of my knowledge. I don't claim to be right or have full details of anything, and that's why I ask.

You probably know something about me too then. Make it known. We are saying how we know Kirk. You seem to be gloating at the fact you know everything. Are you getting off on that or what? I have been refraining from writing on these blogs, but at this point I have to say something. I am very good friends with the innocent little 5 year old and her mother. I have seen 2 people lives completely shattered. I have seen the happiest little girl ever so sad and upset and confused that she is not the same person. I have watched her mother who is one of the happiest fun loving people I know lose the sparkle she had and yet still have to try to pretend for the little angle she has. He has a sister who has lost her only brother that she loved with all she had, who she will never have a bond like she did with Kirk, he had neices and a nephew who loved there Uncle Jr, his parents who are so torn over this they are not sure how to breathe somedays I am sure. There are TRUE friends who heart aches for another chat with him. Just one more night to hang out. In my personal feelings I dont agree with the fact that this man BRODY should be out sleeping in his bed, showering at his home, seeing his family, mainly the mother who is the one who put both these men in this situation by her choices, because what he did took all options of that away for Kirk. The anger that is going back and forth, the comments with no knowledge is just gone over board and I am begging it to please stop. There is a little 5 year old that is going to want to someday look up her dad, who in her eyes is the greatest man she had ever met, yet you people are saying such hurtful things that you are not giving her a chance to love her dad, just for being her daddy! As far as this Sean Humphrey case, do you know the kid had been in trouble numerous times for drinking, and even his dad has stated if he would have not got the alcohol from Kirk, it would have came from somewhere else. He did not beat this kid to death or murder him, he did not even send him away with alcohol, he was just having a drink with a buddy and something so VERY tragic happened. Something that should have never happened and is a horrible sad thing, I am so sorry to the family of Sean. There is a trial about to begin, for the sake of Kirks family I hope that justice is served and Brody goes to prison for a extrememly long time, for the sake of Kirks daughter I hope justice is served so at least she knows the man who took her daddy is not out living his life as if he did nothing wrong. I am sure that at the end of the day Brody is very sorry and wishes he would take it back, but when he was hitting him over and over he had a lot of chances to stop and he chose to not do so. Murder is a horrible hateful crime and justice needs to be served for it. Please stop with the craziness and let people try to deal with there emotions with out these horrible things being said. There is so much guilt from so many people that just want to be able to talk to Kirk one more time, just tell him how much they loved him one more time. There are so many people that this is just tearing to peices and please have the humanity to respect them.
At the end of this day, there are a ton of people who lives have been hurt in so many ways by losing Kirk, I am not saying Kirk was perfect, but to his daughter he was, please let her have that.

For now, I wish to make some observations, concerning violence:
-The human body is very vulnerable. Winners and losers, in a fight, are easily hurt, or worse.
-This is why violence is illegal (to one degree or another), except in CLEAR cases of self-defense.
-An individual, fighting, is afraid for his own safety, often deathly afraid. For this reason (& because of the split-second reactions involved, & because of other factors), it impossible to predict the outcome of a fight.
-It is FOOLish to fight, for safety reasons, and for legal reasons, except as The LAST resort. There are, in most cases, many ways to defuse, or otherwise avoid, or minimize, a conflict.
-To fight, is to accept the consequences. To start a fight - even more so.
-Fighting is not macho, or of itself, a sign of strength, despite what is portrayed in movies.

Back to page topAre you kidding-house arrest? Yep, this is another fine example of our justice system at its finest! Now we are allowing people to be released on house arrest for murder. Its no wonder society is out of control. Our justice system is sending out a mighty fine statement with this one! You can take another person's life and you get out of jail free, unbelievable! Drug users don't even get this privilege, they have to at least post bond which often is excessively high for the crime. So does the court system view murderers as less of a threat to our safety then drug users? I hope not but this judge does. I hope the citizens that put judge dolittle on the bench also remove him/her from the bench before he/she allows more violent offenders to roam the streets freely. Now the issue of self defense because mom was a battered woman-well doesn't mom know about shelters for abused women? I too was a battered wife for 10 years and NOT once did I ever consider murdering my husband. Why because I knew that I would spend the rest of my life behind bars but now the court is sending out the message "go ahead and kill someone, we will let you out on house arrest". Maybe I should move to Chaska Minn so I can do basically what I want without fear of facing the consequences.

-In opting for house arrest, I believe the court is considering: the evidence presented so far, the boy's record, and the controlling of county costs, among other things.
