Jonathan seeks volunteers for lawsuit

 The Jonathan Association is looking for a few good men or women. Earlier this month, Jonathan homeowners received a letter from Jonathan Association Board of Directors President Tom Davis soliciting volunteers for a class action lawsuit.

The lawsuit will be brought to court to seek a resolution to the question of whether or not neighborhoods annexed into the association after the demise of the Jonathan Development Corporation (JDC) in 1979 were done so properly. Attorneys for the board of directors believe that the development rights for new neighborhoods were not transferred to future developers. However, several homeowners have challenged those beliefs.

The board is looking for people with varied perspectives on the issue to participate in the lawsuit. “It is desired to have a representative class so we are asking for people on both sides of this issue to volunteer to be a part of the class,” stated Davis.

According to documents provided to homeowners, those participating will have to incur no costs of their own unless they choose to hire their own lawyer. They may come to court if they choose and are under no obligation to keep other association members informed on the proceedings. The only requirement is that participants remain a representative of their fellow property owners until the time the court makes a final decision.

We got our letter about volunteering to be a part of the lawsuit and in the same bundle of mail I got my bill for the yearly association fee. I'm still trying to wrap my mind around all this... you want me to volunteer my input in a lawsuit that I don't even think should exist AND you want me to pay for that lawsuit via an association fee for an association that you claim our home legally shouldn't be a part of. It's a bit much to ask.

Good point jennyjean4, though residents will incur no direct costs from being involved in the lawsuit, dues money ($125,000) has already been earmarked to cover the anticipated legal costs.
